Terms of Service

These terms are a draft and have not yet been reviewed by an attorney. They will be finalized before Maintd launches publicly.

Please read these Terms of Service ("Terms") carefully before using the Maintd mobile application (the "App"), operated by DJS Collective LLC ("Maintd," "we," "us," or "our"). By creating an account or using the App, you agree to these Terms.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to use the App.

2. The Service

Maintd helps you track maintenance for your home and vehicles, generates a personalized maintenance schedule, and provides AI-assisted do-it-yourself ("DIY") guidance for maintenance tasks. Some features rely on third-party data sources and services, described in our Privacy Policy.

3. AI-Generated Content — Important Safety Disclaimer

DIY instructions, repair guidance, and any other content generated by artificial intelligence within the App are provided for general informational purposes only. This content:

Is not verified against your vehicle's or home system's actual manufacturer specifications, owner's manual, or any authoritative safety database.
May be inaccurate, incomplete, or not applicable to your specific make, model, or situation.
Is not a substitute for your owner's manual, manufacturer's instructions, or the advice of a qualified, licensed professional.

You are solely responsible for verifying any specification, procedure, or safety-related information (including but not limited to tire pressure, torque values, fluid types and capacities, and electrical specifications) against your vehicle or equipment's official documentation or a qualified professional before acting on it. For any task involving safety-critical systems (brakes, gas lines, electrical systems, structural components, carbon monoxide or smoke detectors, etc.), we strongly recommend consulting a licensed professional.

Maintd is not liable for any injury, property damage, or other loss arising from your reliance on AI-generated content within the App. See "Limitation of Liability" below.

4. Your Account

You're responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately if you believe your account has been compromised.

5. Third-Party Services and Links

The App surfaces information from or links to third-party services — including vehicle data decoding (NHTSA), parts listings (eBay), local service providers (via Google Places), and instructional videos (YouTube). We do not endorse, warrant, or take responsibility for any third-party service, product, or provider surfaced through the App. Your interactions with any third party (including any purchase, booking, or hire) are solely between you and that third party.

Maintd may receive a commission on certain purchases made through affiliate links shown in the App (for example, parts listings), at no additional cost to you.

6. Your Content

You retain ownership of any photos, notes, or other content you upload to the App ("Your Content"). By uploading Your Content, you grant us a limited license to store, process, and display it back to you as part of operating the App. We do not use Your Content to train AI models, and we do not share it with advertisers.

7. Subscriptions and Payments

Maintd currently offers its core features free of charge. If we introduce paid subscription tiers in the future, additional terms governing billing, renewal, and cancellation will be presented to you before you're charged, and this section will be updated accordingly.

8. Advertising

The App may display advertising. See our Privacy Policy for details on how advertising works and your choices regarding ad personalization.

9. Termination

You may stop using the App and request deletion of your account at any time (see Privacy Policy). We may suspend or terminate your access if you violate these Terms.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP, INCLUDING ANY AI-GENERATED CONTENT, WILL BE ACCURATE, RELIABLE, OR ERROR-FREE.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MAINTD AND ITS OPERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROPERTY, PERSONAL INJURY, OR DEATH, ARISING FROM OR RELATED TO YOUR USE OF THE APP OR RELIANCE ON ANY CONTENT WITHIN IT, INCLUDING AI-GENERATED DIY GUIDANCE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we'll notify you through the App or by email before the changes take effect. Continued use of the App after changes take effect constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by the laws of the State of Illinois, without regard to its conflict of laws principles.
